Changes to the SEND Tribunal Process

Where a child or young person requests or has an EHC Plan, if they or their family are not happy with decisions made about the plan they have an option to go to the SEN Tribunal. I wanted to notify parents of some changes around the tribunal from the 1st April 2018.

Firstly, I would encourage all parents if they are not happy with provision being made, to discuss with their child’s school or the SEN Team. We want to work with parents to prevent the need for formal appeal to the tribunal and work together to resolve concerns and areas of conflict. Our focus is, and always will be, to try our best to ensure the right provision is in place for every child in the city.

Currently a family can only appeal in regards to the education elements of an EHC plan.
From 1st April 2018, an appeal can also be lodged in regards to the health and care sections of the plan, so long as the appeal also covers the education element of the plan.

The Department for Education have just provided all local authorities with a toolkit to support this process and we will be publishing further information on the local offer website about this.
